How it's calculated

Gratuity is based on your last basic salary only — housing, transport and other allowances are excluded.

Your daily wage is basic salary divided by 30. The first 5 years accrue 21 days of pay per year; each year beyond 5 accrues 30 days.

You must complete at least one full year of continuous service. Partial years after that are paid proportionally.

Common questions

How is gratuity calculated in the UAE?

Under Federal Decree-Law No. 33 of 2021, you earn 21 days of basic salary for each of the first five years of service, then 30 days for each year beyond five. Your daily wage is your monthly basic salary divided by 30, and the total cannot exceed two years of basic pay.

Do I get gratuity if I resign?

Yes. Since the 2022 reform, resignation and termination are calculated identically — the old penalty that reduced gratuity for early resignation was abolished. As long as you complete at least one year of continuous service, you receive the full amount.

Is gratuity based on basic salary or gross salary?

Basic salary only. Allowances such as housing, transport and bonuses are excluded. Check your MoHRE contract for your basic wage figure.

What is the minimum service to qualify?

One full year of continuous service. Anything under 12 months yields no end-of-service gratuity.

Is there a maximum gratuity amount?

Yes. Total gratuity is capped at the equivalent of two years of basic salary, under Article 53 of the Labour Law.

Do free zone employees get the same gratuity?

Not always. Financial free zones such as DIFC and ADGM run their own end-of-service schemes (for example the DIFC DEWS plan), which can differ from the federal calculation. UAE nationals are covered by the GPSSA pension scheme instead of gratuity.
